Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Daymark (“Daymark,” “we,” “us”). By creating an account or using our services, you agree to them. If you don't agree, don't use the services.

1. What Daymark is

Daymark provides education and hands-on assistance for setting up cryptocurrency accounts and wallets, and a member support line that helps you assess whether communications claiming to relate to your crypto holdings — calls, texts, emails, links — are legitimate (“verifications”).

3. Eligibility and your account

You must be at least 18 and able to form a binding contract. You agree to provide accurate account information, keep your login credentials secure, and enable the multi-factor authentication we prompt you to set up. You are responsible for activity under your account.

4. Membership, billing, and cancellation

Membership is a recurring subscription billed through Stripe on the plan you choose (monthly or annual). Plans renew automatically until canceled. You can cancel anytime from the billing portal on your member desk; cancellation takes effect at the end of the current billing period, and we don't prorate partial periods.

If a renewal payment fails, we'll retry and notify you. Continued failure may result in suspension of the support line until billing is resolved.

6. Verifications

To perform a verification we may ask you about the communication you received and your account state with the relevant service. Verdicts (“safe,” “suspicious,” “impostor”) are assessments, not warranties. The decision to act — or not act — on any communication remains yours. We may retain records of verifications (see our Privacy Policy) and use anonymized patterns to protect other members.

7. Availability

We staff the line 24/7/365 and build for reliability, but we do not guarantee uninterrupted availability. Outages, maintenance, and events beyond our control can interrupt service.

8. Disclaimers

The services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of liability

To the fullest extent permitted by law, Daymark will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost funds, or lost digital assets — including losses caused by third-party fraud, even fraud we assessed. Our total liability for all claims in any 12-month period is limited to the membership fees you paid us in that period. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

10. Indemnification

You agree to indemnify Daymark against claims arising from your misuse of the services or violation of these Terms.

11. Termination

You can stop using the services and cancel at any time. We may suspend or terminate accounts that violate these Terms; if we terminate without cause, we'll refund the unused portion of your current period.

12. Changes

We may update these Terms. For material changes we'll notify you by email or on the member desk at least 14 days before they take effect. Continued use after that constitutes acceptance.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and give us 30 days to try to resolve it informally. Disputes not resolved informally will be brought in the state or federal courts located in Delaware.
